Compliance Certification

This is what you certify when you open a LeadQuarry account, and again at each renewal. We may ask for the supporting evidence at any time, and a false certification is a material breach of the Terms.
What You Certify
You have reviewed and will comply with the Terms of Service, the Data Use Agreement, the Acceptable Use Policy, the TCPA and Do-Not-Call Policy, the Commercial Email Policy and the FCRA Notice.
You understand that public-record-derived leads are not consumer inquiries and are not consent.
You have documented your lawful purposes and will not use Lead Data for an FCRA or any other eligibility purpose.
You hold every licence, registration, bond and approval your services and your outreach require.
You maintain written do-not-call, email, privacy, security, complaint and records procedures appropriate to what you actually do.
You will use current federal, state and internal suppression screening, and will not use registry data for any other purpose.
You will obtain and preserve channel-specific and seller-specific consent wherever it is required, and will not represent that LeadQuarry supplied consent unless a product expressly includes verified consent evidence.
You will identify yourself accurately, use truthful content, honour opt-outs, control frequency and calling hours, and monitor your vendors.
You will not resell or disclose Lead Data except to approved processors under protective contracts.
You will report material complaints, regulatory inquiries and incidents to us within one business day.
You will retain auditable evidence and produce it on reasonable request.
You will delete or suppress Lead Data when it expires, is recalled, is no longer needed, or when the law requires it.
Your answers and evidence are accurate and complete, and you will tell us before any material change.
Annual Evidence Checklist
On request you produce: your legal entity and good standing; professional licences; the states you serve; the services you offer; the calling, texting and email technology you use; your National Do Not Call subscription or SAN where applicable; state registrations; sample scripts and templates; your privacy notice; your suppression workflow; your vendor list and contracts; a security contact; an incident plan; complaint metrics; and a deletion attestation.
How the Certification Is Recorded
Certification is captured when you order, recorded against your account with its version and timestamp, and renewed annually. We record who certified and the niches, states, services and channels you declared.
