Commercial Email Policy

The CAN-SPAM Act generally regulates commercial email — including business-to-business email — and does not create a general federal opt-in requirement. State privacy, unfair-practice, professional and sector rules can impose additional duties. An email address found in a public record does not mean its owner asked for marketing. This policy sets out obligations you accept under your agreement with LeadQuarry. It is a contractual requirement, not legal advice, and not a complete statement of the law that applies to you. Take your own counsel's advice before you launch.
Your Obligations as Sender
You are the sender of every commercial message you build on LeadQuarry data. Before you send one, you must:
Use accurate routing, From, To, domain and reply-to information.
Use a subject line that is not deceptive.
Identify the message as an advertisement where that is required.
Include the sender's valid physical postal address.
Provide a clear, conspicuous, working opt-out that is easy to use and does not require payment, a login, or unnecessary information.
Honour opt-outs within the legally required period — no later than 10 business days under CAN-SPAM — and keep the mechanism live for at least the required period.
Maintain suppression so an opted-out address is never mailed again or transferred for marketing, except to a provider helping you comply.
Monitor your agencies, affiliates and vendors. Outsourcing does not move the responsibility.
Preserve send, template, sender-identity, suppression and vendor records.
Prohibited
Do not use unlawfully harvested addresses, dictionary attacks, misleading headers, deceptive subject lines, or relays without permission, and do not treat a LeadQuarry record as evidence of opt-in.
For divorce, probate or distress-related events, a subject line must not expose the event to anyone who sees the inbox, and must not imply a confidential or professional relationship that does not exist.

How the Platform Helps
LeadQuarry records outbound sends and link clicks, maintains per-address unsubscribe state, and excludes suppressed addresses from subsequent sends. These are aids to your compliance programme. The sender identity, the postal address, the content and the legality of the campaign remain yours.
